These Terms of Service ("Terms") govern your access to and use of emonster.app, emonster product websites, contact and support forms, emonster mobile apps and software products, and related software design, development, consulting, and product services offered by emonster, inc. ("emonster", "we", "us", or "our") (collectively, the "Services"). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

Use of the Services

You may use the Services only for lawful purposes and in accordance with these Terms. You are responsible for the information you submit, the accuracy of your inquiry or support request, and your compliance with applicable laws.

You may not misuse the Services, interfere with their operation, attempt unauthorized access, scrape or harvest content without permission, submit spam or vendor solicitations, infringe intellectual property rights, upload malicious code, or use the Services to harm emonster, our clients, our users, or third parties.

Project Inquiries and Client Services

emonster provides selective software product strategy, design, development, consulting, and related services. Submitting a project inquiry does not create a client relationship, guarantee a response, reserve availability, or require emonster to accept a project.

Any paid client work requires a separate written agreement, statement of work, or accepted proposal. If there is a conflict between these Terms and a signed client agreement, the signed client agreement controls for that client work.

Service solicitations, staffing pitches, SEO outreach, vendor introductions, and similar sales messages are not accepted through the Services and may be ignored or filtered.

Apps, Software, Purchases, and Subscriptions

emonster apps and software may be distributed through Apple, app marketplaces, product websites, or other channels. Purchases, subscriptions, refunds, family sharing, taxes, and marketplace entitlements may be handled by the applicable app store or payment provider and are subject to their terms in addition to these Terms.

Some products may have additional product-specific terms, privacy disclosures, or license agreements. If product-specific terms apply, they supplement these Terms.

Intellectual Property

The Services, including websites, software, apps, designs, text, graphics, code, product names, logos, trademarks, service marks, inventions, patents, and related content, are owned by emonster or its licensors and are protected by intellectual property laws. Except as expressly allowed by these Terms or a written agreement, you may not copy, modify, distribute, sell, sublicense, reverse engineer, or create derivative works from the Services.

Feedback

If you send ideas, feedback, bug reports, suggestions, or similar input, you grant emonster a worldwide, perpetual, irrevocable, royalty-free right to use that feedback without restriction or obligation to you.

Third-Party Services and Links

The Services may include links to app stores, client websites, analytics services, payment providers, maps, social platforms, and other third-party services. emonster is not responsible for third-party services or their content, policies, availability, or practices.

Disclaimers

The Services are provided "as is" and "as available". To the maximum extent permitted by law, emonster disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, and security.

Limitation of Liability

To the maximum extent permitted by law, emonster will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, business interruption, or loss of goodwill arising out of or related to the Services. emonster's total liability for any claim will not exceed the greater of the amount you paid to emonster for the applicable Service in the three months before the claim or USD $100.

Indemnity

You agree to defend, indemnify, and hold harmless emonster, its officers, directors, employees, contractors, and agents from claims, damages, liabilities, losses, and expenses arising out of your use of the Services, your submitted content, your violation of these Terms, or your violation of law or third-party rights.

Changes and Termination

We may update, suspend, discontinue, or restrict access to the Services at any time. We may update these Terms by posting a revised version on this page. Continued use of the Services after changes are posted means you accept the updated Terms.

Governing Law

These Terms are governed by the laws of the State of Washington, without regard to conflict of law principles, unless a written agreement with emonster states otherwise.
